Safety vs. Cost: The School Nurse Lawsuit

It was a typical day at school until the unthinkable happened: a young student suddenly collapsed, hitting the floor and becoming completely unresponsive. The school nurse, acting on years of training and strict medical protocol, didn’t hesitate. Seeing the child in a vulnerable state, she immediately dialed 911 to summon an ambulance, fearing the worst for the girl’s safety.

However, the gratitude the nurse expected never came. Instead, she found herself standing in a courtroom.

The child’s mother had filed a lawsuit against the nurse, driven by anger over the expensive ambulance bill. In the courtroom, the tension was palpable as the mother argued her case: “Your Honor, my child ended up being perfectly fine. The ambulance was an unnecessary expense, and now I am stuck with a bill I shouldn’t have to pay.”

The nurse, standing by her professional judgment, responded calmly: “Your Honor, the child had collapsed and was not responding to me. I followed protocol because my only concern at that moment was her life and safety.”

After hearing both sides, the judge’s decision was firm. He looked at the mother and declared that calling emergency services for a child in medical distress is not a “wrongdoing”—it is the only responsible choice a caregiver can make. He ruled that a child’s life is worth far more than the cost of a transport fee.

The case was dismissed, serving as a powerful reminder that in an emergency, safety must always come before the bottom line.
