When asked how much longer the “daycare scam” would continue, the owner reportedly replied that they would do it for another year or two before buying “nice homes in Nairobi.” At the time, this owner was simultaneously receiving public assistance. Swanson’s team was on the front lines of identifying these red flags, yet he testified that by mid-2017, the focus of the administration shifted from stopping the fraud to targeting the investigators themselves.

The scope of the fraud is difficult to overstate. Investigative reports from 2018, which were presented during the hearings, contained explicit warnings that internal controls were woefully insufficient to stop the bleed. Perhaps most distressing was the evidence on page 55 of the whistleblower report, which indicated that large sums of money were being wired to banks in the Middle East and Africa shortly after providers received state payments. The report stated it was a “near certainty” that a percentage of these proceeds were being siphoned off by designated terrorist organizations. Despite this knowledge, the investigative unit led by Swanson was reportedly shut down shortly after Governor Walz took office in 2019.

State Representative Kristen Robbins, chair of the state’s fraud prevention committee, described the situation as “unconscionable.” She noted that instead of diving in to fix the problem, the administration allegedly barred state criminal investigators from speaking with their counterparts at the Bureau of Criminal Apprehension without supervisor approval. This move, according to Robbins, effectively ended criminal deterrents and transformed the oversight process into a toothless bureaucratic exercise. “They enabled this,” Robbins stated bluntly. “They turned a blind eye.”

Robbins suggested that the failure to act was rooted in a desire to protect a political base, specifically within the Somali community, where some of the fraud was concentrated. However, she was quick to point out that many of the whistleblowers themselves are from the Somali community, individuals who are desperate to see their community cleared of criminal actors. The narrative that the fraud was “make-believe”—a term reportedly used by Governor Walz in the past—has been flatly rejected by those on the ground. Fay Bernstein, another whistleblower who considers herself a lifelong Democrat, called the “make-believe” assertion “craziness,” noting that she sees the reality of the fraud every single day.

The lack of state-level action has forced federal partners to step in. It was only through the work of federal investigators and independent journalists that many of these fraudulent systems were finally exposed. Robbins highlighted a list of 72 childcare centers flagged for suspicious activity that was handed to the administration over a year ago, yet she claims no significant action was taken until federal raids made the issue impossible to ignore. The investigation is also extending into the actions of high-profile political figures like Representative Ilhan Omar, who has been requested to provide documents related to her support of the Meals Act, which some believe inadvertently facilitated further fraud.

As the deadline for document requests passes, the possibility of subpoenas looms. The courage of whistleblowers like Swanson and Bernstein has pulled back the curtain on a system that appeared to prioritize political optics over the safety and security of public funds.
